Applied Electric Vehicles Ltd is part of the Applied EV Group, which includes Applied EV UK Ltd and Applied EV Hungary Kft (collectively referred to as Applied EV). Applied EV is committed to protecting and respecting your privacy. This Privacy Policy sets out how Applied EV, as data controller, uses your personal data.

Applied EV has appointed Applied EV UK Ltd to be Applied EV’s representative within the EEA.

1.         Personal data we collect

1.1       Applied EV collects and processes some or all the following types of information from or about you:

(a)   Personal identification information, such as first and last name, title, date of birth, signature, and contact information (for example, address, phone numbers and email addresses).

(b)  Payment information, such as name, bank account name and number, credit card details and other financial information.

(c)  Audio visual information, such as footage recorded for security, safety, and research and development purposes; footage recorded at events; or information captured when interacting with our products and services.

2.1   You provide Applied EV with most of the personal data we collect through our interactions, including when you:

(a)   purchase or use our products or services;

(c)   apply for a role with Applied EV;

(d)   correspond with Applied EV, including by email; or

(e)   are recorded when interacting with, or as part of the research and development of, our products and services, including images, video, sound and data captured by sensing systems used in our products.

2.2     We also obtain data about you from third parties, such as customers, suppliers and partners, and indirectly through your use of our website, including through cookies and usage data.

3.1      We may collect and use your personal data to:

(a)   provide our products and services, which includes the operation of our vehicles, maintenance, support and sharing data as required to carry out services;

(b)  improve and develop our products and services, including improving driving performance and customer experience;

(c)   operate our business, including processing payments, developing our workforce and complying with our legal, regulatory and contractual obligations;

(d)   carry out transactions you have requested;

(e)   advertise and market to you in accordance with applicable laws;

(f)    protect our rights and property and that of users and others;

(g)   detect, prevent and respond to fraud, abuse and security issues; and

(h)    satisfy purposes related to the above.

3.2    We may share your personal data with the following third parties:

(a)   Law enforcement agencies, in connection with investigations or to help prevent fraudulent or unlawful activity.

(b)   Third party service providers (but only if we have relevant protections in place, such as to safeguard your privacy rights and ensure confidentiality):

(i)   to help us provide our products and services; or

(ii)   for hosting or processing of data, such as cloud storage or monitoring of emails.

(c)   Any third parties as required by law, or to comply with legislative or contractual requirements.

3.3    Applied EV will not use your personal data for spam and will not sell or rent it to anyone.

4.        Lawful basis for processing

4.1     The lawful bases on which we process your personal data are as follows:

(a)   Carrying out tasks that you have consented to.

(b)   Performing a contract to which you are party, or for precontractual steps at your request.

(c)   Compliance with legal obligations we are subject to.

(d)   Protecting your vital interests or those of another person.

(e)   Performing tasks that are in our (or a third party’s) legitimate interests, or that are carried out in the public interest. Such legitimate interests include:

5.        Cross border transfers

5.1     Applied EV is based in Australia, with subsidiaries in the UK and Hungary. The data that we collect about you from the UK and/or European Economic Area (EEA) may be transferred to, and stored at, a destination outside the UK or EEA, including Australia, USA, Japan and Brazil. We may also share some personal data with our employees, partners or suppliers working outside the UK or EEA. By providing us with your personal data, you agree to this transfer, storing and processing.

5.2   We store personal data in cloud storage that is hosted within Australia and externally and may be processed in other countries. This means it is not always practicable to determine the countries in which your personal data may be stored or accessed, and your personal data may be disclosed in countries other than those listed above.

6.1    Applied EV will retain information we collect for as long as reasonably necessary to fulfill the purposes for which it was collected, or to satisfy our legal or contractual obligations. We will make reasonable efforts to remove or deidentify personal data after it is no longer required for the purposes for which it was collected.

7.1     Applied EV would like to send you information about products and services of ours that we think you might like.

7.2     If you have agreed to receive marketing, you may always opt out at a later date. You have the right at any time to stop Our Company from contacting you for marketing purposes or giving your data to other members of the Our Company Group.

7.3     If you no longer wish to be contacted for marketing purposes, you can click unsubscribe from the bottom of the email received.

8.1     Applied EV’s website and services are not intended for use by anyone under the  age of 16. Applied EV does not knowingly collect data from or about children.

10.1    Applied EV takes reasonable administrative, technical, and physical security measures to:

(a)   protect your personal information against unauthorised or unlawful processing and against accidental loss, destruction or damage and

(b)   ensure that it is used in accordance with this Privacy Policy.

10.2    We limit access to your personal data to those who have a genuine business need to know it. Those processing your personal data will only do so in an authorised manner and are subject to a duty of confidentiality.

10.3    We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

(d)   The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.

(e)   The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.

(f)    The right to data portability – You have the right to request that we transfer the data that we have collected to another organisation, or directly to you, under certain conditions.
